Making Donations through SMC.
SMC is a non-profit marketplace that brings Donors together with Clubs in order to provide students with the activities and materials they need to learn. Here, 100% of each donation made through SMC goes directly to fund the charitable program for which it was given, unless the Donor indicates that a specific portion of the donation may be used for administrative purposes.
Included in the "product cost" are: shipping charges, sales tax, credit card processing fees (regardless of payment method), and a 15% fulfillment fee which covers the staffing cost of posting and procuring item requests, donor thank you note processing, and community service tracking. All Donors are subject to the specific Donor terms described below.
All donations are tax deductible to the fullest extent allowed by law. You may view a copy of our annual financial statements and federal tax return online by clicking on the links or you can obtain them by writing to:

1. You are a U.S. citizen at least 18 years old or if under 18 years old are acting with parental consent and under parental supervision;
2. All information you provide to SMC is accurate, and you will update the information to keep it accurate; and
3. Any donation you make is legal in your jurisdiction.
You will be responsible for the use and maintenance of the confidentiality of your user ID and password (which you will receive upon completing the process of registering as a Donor) for access to Donor-restricted portions of the Sites, and shall not share your ID and password with anyone else. You agree not to use the account, username, or password of another Donor or Club at any time or to disclose your password to anyone else. You agree to exit from your account at the end of each session and to immediately notify SMC of any unauthorized use of your password or account. You are solely responsible for any and all use of your account and for any actions that take place using your account. All suggestions and comments you provide become the intellectual property of SMC.
In addition to the rights of SMC described elsewhere in this UA, you agree that descriptions of the proposed activity, the photographs of students and the thank-you notes, and other materials that SMC may send you regarding each request you fund are solely for your personal, non-commercial use and may not be distributed, displayed or copied in any way. Recognizing the critical importance of these restrictions in protecting the rights and privacy of the participants, you agree that any breach by you of any of these restrictions may cause SMC and others to suffer irreparable loss, damage and harm in an amount not easily ascertained, and therefore agree that SMC may immediately seek an injunction against you to stop your distribution, display, or copying of any such materials and you waive any objection to the scope or venue of such an action.
Services Provided by SMC
We verify that each Club is in fact an officially recognized club at its school (e.g. by reviewing completed constitutions and/or bylaws, verifying school official approval, etc). We review, verify and calculate the cost of each Club request before we post it on the Sites for Donors to view. Our efforts include, but are not limited to, screening the proposed student requests for compliance with the SupportMyCLub.org eligibility requirements, restricting Clubs to addresses that have been provided by the school system as correct school locations, confirming the existence of requested materials, and determining a cost for the request. Whenever practical, we purchase the necessary materials ourselves and arrange for them to be delivered to the Club's school. For all donations of, we arrange to the best of our ability for a Club letter, photographs of students engaged in the activity and student thank-you notes to be sent to the Donor(s) after student receipt of the item(s).
Sometimes the specific components included in a Club request change after we receive your donation. In the unusual case that this happens, SMC will review the Club's modified request. If our review determines the modified request is reasonably similar to the Club's original request, we will use the funds that you donated to pay for the modified request. If we determine that the modified request is not reasonably similar to the original request, we will return your donation in the form of a SMC Credit. You may use this Credit to fund an alternate Club request.
SMC reserves the right to exclude any Donor from use of the Sites, in SMC's sole discretion. All directions and requirements stated on the Sites regarding Donors or donations shall apply to any donation offered or made by you.
If, for any other reason, the request cannot move forward (i.e., the Club no longer operates at the specified school or no longer requires the requested materials, or the Club is no longer in good standing with SMC, etc.), all donations made to the request will be returned to the Donor as account credits which will then follow the procedure outlined above.
In rare instances, a Club fails to submit a thank you for the request they have had funded at SMC. In this instance, all Donors will be notified by SMC and the Club will be excluded from future use of the Site.
SMC cannot be responsible for the success of any proposed or funded requests or for the activities (or lack thereof) of the Clubs or students participating in any proposed or funded requests.
Special Provisions for Clubs
Thank you for your interest in submitting a request for a SupportMyClub.org item. By clicking the "I Agree" button during the process to sign up for funding requests, the following additional terms of the UA apply to those users who sign up for a Club account and/or to post a Club funding request on the Sites ("Clubs"):

You will be responsible for the use and maintenance of the confidentiality of your user ID and password for access to Club-restricted portions of the Sites, and shall not share your ID and password with anyone else. You agree to provide student thank-you notes that do not contain any of the personal information that will identify the student. From time to time, SMC or a third party on SMC's behalf may send you emails regarding important information regarding your use of the Sites. SMC reserves the right to exclude any Clubs from use of the Sites, in SMC's sole discretion.
Your Responsibilities Should Your Request Be Funded

SMC will not be required to treat any Submission or Request as confidential.
